New York apostille

Fee $10 · Reviewed November 2026

Documents issued or notarized in New York are apostilled by the Apostille and Authentication Unit, Division of Licensing Services, New York Department of State. The office authenticates the signatures of New York public officials — registrars, court clerks, state agencies — and New York-commissioned notaries public, then attaches an apostille for Hague Convention countries or an authentication certificate for all others.

Issues Apostilles for Hague countries and Certificates of Authentication for non-Hague countries; the latter may need further US Department of State certification.

How to get a New York apostille

  1. Confirm the document is a New York public document

  2. Obtain county certification where required

Notarized documents must first be certified by the County Clerk of the county where the notary is commissioned. Vital records issued by local/county registrars and divorce certificates must be certified by the County Clerk of the issuing county. NYS Department of Health vital records signed by the Director of Vital Statistics/State Registrar need no county certification.

Birth, marriage and death certificates

NYS DOH records signed by the Director of Vital Statistics go straight to DOS. NYC DOHMH birth/death/marriage certificates must first be certified by the New York County Clerk, and birth/death certificates also need a 'Letter of Exemplification' requested when ordering. Local-registrar-issued records need County Clerk certification first.

See the document guides for birth, marriage and death certificates.

New York-specific points

  • Two-step process: nearly everything must be certified by a County Clerk before the Department of State will act.
  • NYC-issued birth/death certificates need both New York County Clerk certification and a Letter of Exemplification from the NYC DOHMH.
  • Five walk-in offices (NYC, Albany, Binghamton, Buffalo, Utica) with a 10-document same-day cap.
  • Request form DOS-1917-f available in Spanish, Haitian-Creole, Italian, Korean, Russian and Chinese.
  • Mail requests must use the PO Box; express carriers must use the Albany street address.

Federal documents and non-Hague destinations

New York does not apostille federal documents. An FBI background check, Certificate of Naturalization, DD-214, IRS letter or Social Security letter issued to a New York resident is authenticated by the U.S. Department of State in Washington, D.C. — see the federal section. For destinations outside the Hague Convention, the New York authentication certificate must then be authenticated by the U.S. Department of State and legalized at the destination's embassy (how the chain works).
